Hi, my name is Richard Noah. I’m a licensed mortgage broker that has for years relied on staying in touch with my database
of clients by sending post cards, email and periodically calling them on the telephone.
Like so many business owners, I always supplemented my business by trying to locate potential new clients by either buying leads
from third party lead generating companies or by hiring telemarketers to make the calls for me from their lists.
I mean after all, if you don’t have a constant source of new clients to generate sales, any business will very quickly start to loose market share and eventually go out of business.

Eventually, the more calls we made to the individuals on the lead sheets, the more the people complained that they had already talked to someone and didn’t want to be bothered any more.
We continued calling and kept running into the same complaints, until we started to receive verbal notice from people we were calling, they had placed their name on the National Do-Not-Call Registry.
First it was just one or two individuals. Then it increased to three, four, five, and then more and more.

I was offering a great service but people were becoming agitated, almost hostile when I called. I had heard of the National Do-Not-Call Registry and thought I knew all about it. I mean, I read the articles that were printed occasionally in the newspaper.
I was confident that the lead company was giving me clean lists.
They said so, assuring me even in writing that their leads had no telephone numbers that were registered on the Do-Not-Call Registry.
I told them that they needed to make sure their list was clean, for all of the money that I was paying. Right?
You know what they told me?
They said the final responsibility for making sure that the
telephone numbers on their lead list wasn’t theirs but mine!
I became enraged, but was shortly blind sighted when a colleague of mine told me of a complaint
that had been made to the FCC by one of the people on our shared list of leads.
It was demanded that an immediate response
was needed with a company Do-Not-Call office policy
and a list of everyone that in response to solicitations made had requested, their name and number,
never to be called again. What?
This letter was very serious and I came to find out that the potential liability was incomprehensibly large
for each incident.
OK, I guess I needed to become more aware of what the laws were and how they impacted my business and me.
I started to investigate
and found that there was very little prepared in the way of information other than a huge assortment of
government papers, reports, and copies of the law.

I was motivated to continue my search for as much information concerning the Do-Not-Call rules and
regulations as I could find. Eventually, I started making progress. Look at some of the information
I uncovered.
I found out that all of these Consumer Protection Laws that are now being
aggressively enforced by the Fed and individual states was because of the bad business practices
being made by a small number of businesses that bordered on harassment.
So now…
• If you make telephone
calls to potential customers or even receive calls from potential customers because of your
advertising, you’re automatically subject to follow the two different federal agencies regulating telemarketing
laws, not including those from your individual state. The difference is if you make or receive calls from out-of-state
or just make or receive calls from in state.
• Every business, regardless of size, or where you do business, is now required to have an up-to-date written
company Do-Not-Call office policy that can be produced immediately if any independent outside individual
consumer asks for it and if you can’t or you refuse, you can be subject to a very heavy fine. |
Don't Miss This, It's To Important
There are an increasing number of private entrepreneurs that are deliberately going after businesses that are unknowingly violating this particular federal law. It’s quickly becoming one of the biggest scams to be played against businesses across the board.
These individuals and, more commonly, law firms blanket businesses with demands to see compliance documentation and if the business cannot show compliance, they will then threaten a lawsuit, unless, they make an out of court settlement, usually a third of the potential fine.
Oh, and do you know what the fine is? It can be $11,000 per each incident.
• Individuals you call may request that your company or business put them on
your individual Do-Not-Call registry immediately. If you don’t and you make the mistake in calling them again,
you could suffer a very hefty fine, if they file a complaint.
• Any lead list you purchase, regardless from what source, you personally are responsible to make sure
all the names are scrubbed against the National DO-Not-Call Registry once every 31 days. |
